The well-respected Western Cape high court judge was named after the April interviews where the JSC overlooked David Unterhalter a third time.

Hence the Electoral Commission of South Africa could not postpone local government elections until early this year because of concerns that they would not be free and fair because of the Covid-19 pandemic. He has since 2017, also acted at the Supreme Court of Appeal. His rulings include setting aside the sale of South Africa’s strategic fuel reserves, and the majority judgment in which the constitutional court held that the courts did not have the power to extend the constitutional time limit for elections to be held.

Rogers was appointed to the Western Cape High Court in 2013 and before that was a highly regarded senior counsel at the Cape Bar. He is known for the breadth of his legal knowledge, with expertise in many areas including competition law (he has been a judge of the Competition Appeal Court since 2016), tax law and pension funds law. After a number of acting stints at the Supreme Court of Appeal (SCA) from 2017 to 2021, Rogers acted at the Constitutional Court in 2021 and was part of the bench that steered the country through the litigation-fraught 2021 local government elections, penning the majority decision that rejected the IEC’s application to postpone the elections. The appointment of the highly regarded jurist sees the apex court closer to its full complement of 11 justices after a prolonged period of vacancies

Owen Rogers is known for the breadth of his legal knowledge, including expertise in competition law, tax law and pension funds law.

Rogers was finally to get the nod for high court appointment in 2013. Should Maya get the nod as expected, the apex court will be just one justice short of a full 11. Rogers was first nominated for the high court in 2011. There have been no white judges on the apex court since Johan Froneman’s retirement, but a woman appointment would have been a boost for gender representativeness, something Ramaphosa is known to support. Unanimous judgments that he penned alone at the ConCourt took about three months. Unterhalter’s exclusion meant Ramaphosa could only fill one vacancy at the apex court even though the JSC had advertised for two.

Ramaphosa appoints Judge Owen Rodgers as ConCourt judge (Johannesburg Sunday World)

Judge Owen Lloyd Rodgers has been appointed as a Judge of the Constitutional Court of South Africa, the Presidency confirmed on Wednesday.

Rogers acted at the SCA from 2017 to 2019 and again in 2021. Rogers term as judge in the ConCourt takes effect from 1 August 2022. “President Ramaphosa wishes Judge Rogers well in his new role,” said the Presidency.

Constitutional Court, SCA among the courts with judicial vacancies (News24)

The Judicial Service Commission (JSC) has invited nominations to fill vacant judicial positions at various superior courts.

The position of judge president in the KwaZulu-Natal Division of the High Court and the Limpopo High Court was also vacant. Other vacant positions include one vacancy for a judge in the Gauteng Division of the High Court for secondment to the Land Claims Court and four vacancies of judges in the Gauteng High Court. One vacancy of Chairperson of the Electoral Court and a candidate nominated for this position should be a Judge of Appeal of the Supreme Court of Appeal. There is also one vacancy for a judge at the same court.
