Eskom's Employment Equity Plan under fire (Mining Review)

This is according to Eskom's Employment Equity Plan for 2023 to 2025. In a letter issued by Solidarity's legal team addressed to Eskom, Solidarity asks for a moratorium on race-based appointments at Eskom as a measure to help address the power crisis.

Solidarity is also preparing for a court case to get Eskom exempted from black economic empowerment requirements. Solidarity also points out that Eskom has a long history of having an aggressive race policy. In the letter Solidarity points out that there is an urgent need in South Africa for the deployment of best skills in jobs regardless of race. “Targets such as these discourage existing staff members and also imply that competent white persons cannot apply for jobs to help solve the crisis. “These absurd race targets come amid the fact that power station maintenance is one of Eskom’s major challenges. While the country is reeling from load shedding, Eskom wants to get rid of another 500 white males by 2025, mainly persons who are responsible for maintenance work.

A skills-based approach to recruitment not only promises to be faster and more effective but also fairer as resumes no longer need names, years of experience, or the various other things that may bias our decisions. [MilGears](https://milgears.osd.mil/) platform allows both service members and veterans to capture any skills that are acquired via on-the-job experience, education, or training. This has placed those who haven't been able to get a degree at a clear disadvantage in the labor market as those with credentials are nearly always chosen ahead of them, even if they have more relevant skills to offer. [ Human Capital Trends](https://www2.deloitte.com/us/en/insights/focus/human-capital-trends.html) report, consulting firm Deloitte argues that a skills-based approach would help to fill that gap. What’s more, the upward mobility of these people is far less than that of their peers with degrees. The MilGears platform offers an example of how this might emerge. The researchers estimate that around 1 million young people enter the job market each year with just a high school education. It's an approach that Deloitte has helped to spread via the [ OneTen](https://oneten.org/) initiative, which is a coalition formed in 2020 by 37 founding companies to help one million Black individuals advance despite not having a four-year degree. Evidence shows that there are millions of "invisible" workers across the economy that are not being utilized by organizations today. With the Covid pandemic prompting many to leave the workforce, the problem has only become more severe. “So we focus on the non-college population at an early age. Almost two years ago, casual workers were given the right to convert to permanent employment. So, how have Australian employers been managing the process?

Encouraging managers to regularly assess their obligation to offer casual workers the option to convert and track conversion rates allows businesses to use their existing workforce better and identify opportunities for improvement. Van Den Bosch reported that it was in both the company’s and team’s best interests for work to be guaranteed on a contracted basis with access to entitlements such as annual and carer’s leave to maintain a meaningful workforce. Diving further into flexibility, Van Den Bosch said for the majority, permanent work is in their best interests, but some people are prepared to forgo entitlements for the benefit of flexibility. Woolworths’ commitment to offering casual conversion centres around a focus on going over and above minimum requirements set within the enterprise agreement and the law. At present, casual workers make up the second largest proportion of Woolworths employees at 40%, just below part-time workers, which make up 44%. In addressing the Committee, Napoli Hala said she believed the company’s causal workforce enjoyed the flexibility casual work gives them to work around their studies. By comparison, part-time employees need to engage with a manager or supervisor through MyJob regarding changes in their availability to ensure any award obligations are still being met or leave requests are processed correctly, removing some of the flexibility afforded to casual workers. Of McDonald’s approximately 109,000 crew members (83% of which are casuals), the average age is 18 years old, so it is no surprise that some 70% of their employees are at high school, TAFE or university. An employer must notify the employee if it decides not to make an offer and include the grounds upon which it has decided not to do so. To quickly recap, in March 2021, a new casual conversion right was inserted into section 66B of the Fair Work Act 2009 (Cth). After a low rate of casual conversion uptake, McDonald’s chief people officer Emma Napoli Hala cited flexibility to choose hours and loading rates as key reasons why employees did not want to convert. If the employee accepts, the employer must then discuss and give written notice of the terms of the permanent employment within a further 21 days.
